Welcome to kyco, a customer profiling and email marketing platform that empowers businesses to effectively reach their target audience. By accessing and using our services, you agree to comply with the following Terms and Conditions ("Terms") outlined below. Please read them carefully before using kyco's services.
Acceptance of Terms: By using kyco's services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, including any additional guidelines and future modifications. If you do not agree to these Terms, you may not use kyco's services.
Description of Service: kyco provides an email marketing platform that allows users to send unlimited emails to their marketing database. Includeing sending emails to up to a maximum of 2,500 contacts in the user's marketing database, at an entry monthly cost of £279. This number can change depending on the chosen package.
Upgrading Contact Limits: As your business grows and requires a larger contact database, kyco offers additional tiers with increased contact limits. If you exceed the maximum limit of 2,500 contacts, you will be contacted and automatically upgraded to ensure your business operates as normal. The tier increases are as follows:
Tier 1: Up to 2,500 contacts - £249 per month (base tier)
Tier 2: 2,501 to 5,000 contacts - £289 per month (£249 + £40 extra)
Tier 3: 5,001 to 10,000 contacts - £339 per month (£249 + £90 extra)
Tier 4: 10,001 to 15,000 contacts - £429 per month (£249 + £180 extra)
Tier 5: 15,001 to 25,000 contacts - £529 per month (£249 + £280 extra)
Automatic Tier Upgrades: kyco's services include monitoring the growth of your contact database to ensure you have the appropriate tier for your needs. If your contact count exceeds the limit of your current tier, kyco will automatically upgrade your account to the next tier at the beginning of the next billing cycle. The corresponding fee for the upgraded tier will be applied accordingly. kyco will notify you of the tier upgrade and the new billing amount.
Unlimited Email Sends: Regardless of the tier you are subscribed to, kyco allows unlimited email sends. We believe in encouraging growth for your business and do not impose any limits on the number of emails you can send through our platform.
Payment Terms: a. Payment Method: By using kyco's services, you agree to provide accurate and complete payment information. You authorise kyco to charge the specified amount to the provided payment method on a monthly basis. b. Billing Cycle: Billing will occur monthly, starting from the date of your initial subscription. c. Fee Changes: kyco reserves the right to modify the fees associated with the different tiers by providing advance notice to customers. d. Taxes: All fees are ex VAT, VAT is calculated upon purchase.
You have the right to cancel your kyco subscription at any time, provided you give a minimum of 30 days' notice. To initiate the cancellation process, please notify us in writing by emailing gethelp@kyco.uk
kyco reserves the right to terminate your access to the services immediately if you violate any of the terms outlined in this agreement or engage in any unauthorized use of the platform. Upon termination, you will no longer have access to your kyco account, including any data or contacts stored within the platform. It is your responsibility to backup and retrieve any necessary information from your account before the termination takes effect.
kyco may retain certain data and information for up to 90 days related to your account as required by applicable laws and regulations or for legitimate business purposes.
Account Security: You are responsible for maintaining the confidentiality of your kyco account credentials, including your username and password. Any activities performed using your account are your sole responsibility. Please notify us immediately if you suspect any unauthorized access to your account.
Intellectual Property: kyco retains all rights, title, and interest in and to its platform, including but not limited to its website, software, logos, and any related materials. You may not use kyco's intellectual property without obtaining prior written consent.
Limitation of Liability: kyco shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from or in connection with the use or inability to use our services, even if advised of the possibility of such damages.
Indemnification: You agree to indemnify, defend, and hold harmless kyco, its affiliates, directors, employees, and agents from any and all claims, damages, liabilities, costs, or expenses arising out of your use of kyco's services or violation of these Terms.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
Modifications to Terms: kyco reserves the right to modify these Terms at any time, without prior notice. The most recent version of the Terms will be posted on our website. By continuing to use kyco's services, you agree to be bound by the updated Terms.
kyco Wi-Fi data capture: Compatible with Ubiquiti devices. If a business wishes for kyco to install its own Ubiquiti hardware, there may be an additional fee. This is to cover the fees for Wi-Fi gated signups, hardware and monthly licence fee. If you choose to cancel your kyco subscription, the Wi-Fi hardware belongs to kyco and will need to be returned. kyco traditionally will come and collect directly to prevent possible damages in transport.
